Greetings from the Secretariat of UDC 2022.

The Upbit Developer Conference (UDC) Terms of Use will be partially enacted on May 18, 2022, so we inform you as follows:

Chapter 1 General Provisions

 

Article 1 Purpose

The purpose of these Terms and Conditions of Use (hereinafter, the "Terms of Use") are to prescribe the rights, obligations and responsibilities of Dunamu Inc. (hereinafter, the “Company”) and users as well as other necessary matters pertaining to the provision and operation of information and services (hereinafter, the “Services”) for the Upbit Developer Conference (hereinafter, the “UDC”) organized by the Company.

 

Article 2 Definitions

The terms used in these Terms of Use are defined as follows:

1.  “Services” mean information about online/offline UDC events, online/offline registration services, and all other services related to the organization and operation of the UDC events provided by the Company.

2.  “User” means a person that can access online/offline services provided by the Company after completing the registration process.

3.  “Registration” means the act of finalizing the Service Use Agreement where users that intend to use the Services agree to the Terms of Use by submitting a registration application provided by the Company and the Company accepts such application.   

4.  “Purchaser” means a person that purchases a free/paid UDC ticket after registration. 

5.  “Participant” means a Purchaser or a person that acquires the right to take part in the UDC events through the Company or an agency.

6.  “Registrant” means a person that makes a reservation to join the online UDC conference after registration (in the event that the UDC is held online).

7.  “Applicant” means a person or group that submits an application to the Company to participate in a certain program or event after registration.

8.  “Speaker” means a person that is officially selected and designated as one of the UDC speakers. 

9.  “Posting” means any writing, photo, video and other types of files or links containing information in the form of signs, letters, voices, sounds, images or video clips posted by the Company to provide its Services.

 

Article 3 Publication and Amendment of Terms

1.    The Company shall publish these Terms of Use on the Services page or any page that is linked to the Services page to allow the Users easily understand the provisions of the Terms of Use.

2.    The Company reserves the right to amend these Terms of Use, where necessary, to the extent such amendment is in compliance with the applicable laws and regulations.

3.    In the event that the Company desires to amend these Terms of Use, it shall notify the Users of the amended terms and conditions and the effective date from fourteen (14) days to one (1) day prior to the effective date.

4.    In the event that the Company clearly notified the Users that the Users shall be deemed to have agreed to the amended terms and conditions unless they express their intention to reject the amendment at least one (1) day prior to the effective date when publicizing the amended Terms of Use in accordance with Paragraph 3, the Users shall be deemed to have agreed to such amendment if they fail to explicitly refuse to accept the amended terms and conditions.  

5.    In the event that the Users do not agree to the amended Terms of Use, they may terminate the Service Use Agreement by expressing their refusal to the Company at least one (1) day prior to the effective date.

 

Article 4 Other Rules and Regulations 

Any matters that are not set forth in these Terms of Use shall be governed by the applicable laws and regulations of the Republic of Korea should they exist.   

 

Chapter 2 Service Use Agreement

Article 5 Establishment of the Service Use Agreement

1.    The Service Use Agreement shall be established upon completing the registration process.

2.    In the event that the Purchaser needs to register information of several users on their behalf, the Purchaser shall obtain consent to use personal information from each Participant in advance and be responsible for all information about the Participants provided in the application. The Participant whose information is filled out by the Purchaser shall be bounded by the Service Use Agreement in the same way as other Participants.    

3.    All user information contained in the application shall be deemed to be accurate. In the event that the Users fail to provide their real name or accurate personal information, they shall not receive any legal protection and their access to the Services shall be limited.

4.    The Services provided by the Company is available to those aged 14 years and above. The Users shall be deemed to be aged 14 years and above when confirming that they are “14 years or above” during the registration process. In the event that the Users fail to provide accurate information about themselves, they shall not receive any legal protection and their access to the Services shall be limited. 

 

Article 6 Change and Cancellation

1.    The Users shall change and update information in the event that there are some changes in their information submitted during the registration process. The Users shall be held liable for any issues that may arise from failing to change their information.  

2.    The Purchasers, Participants or Registrants can change their information or cancel the registration before the deadline of the registration.

3.    The Participants shall not be allowed to change their information after submitting their application. In the event that the Participant desires to cancel their registration, please contact the UDC Secretariat.  

4.    The Speaker information shall be collected via a separate link. In the event that the Speaker desires to cancel their registration, please contact the UDC Secretariat.

5.    The Company can cancel the registration of the Users in the following events:

1) when the User has registered for the UDC events using other person’s name

2) when the User has provided false information in the application or falsely applied for the UDC events

3) when the User has submitted an application with an intention to harm the welfare of the society, the social order or customs

4) when the User has disturbed the use of the Services by others or steal other person’s information, or

5) when the User has engaged in actions that are prohibited by the relevant laws and the Terms of Use

 

Article 7 Protection of Personal Information

The Company shall make efforts to protect User’s personal information in accordance with the applicable laws and regulations such as the Act on Promotion of Information and Communications Network Utilization and Information Protection and the Personal Information Protection Act. The protection and use of personal information shall be governed by the relevant laws and the UDC Privacy Policy except for any linked websites other than the official UDC website created and provided by the Company.

 

Chapter 3 Obligation and Liability

Article 8 Obligations of the Company

1.    The Company shall always endeavor to provide reliable Services to the Users.

2.    The Company shall be equipped with the adequate security system to protect personal information to enable the Users to use the Services in a safe manner, and disclose and comply with the UDC Privacy Policy. 

3.    The Company shall not disclose or divulge to any third party personal information of the Users obtained in connection with the provision of the Services without their consent unless it is required by the relevant government organizations in accordance with the telecommunication laws and regulations.  

 

Article 9 Obligations of the Users

1.    The Users shall provide their accurate personal information as requested during the registration process. They shall also maintain and update existing information about themselves, prohibit the third party from accessing their personal information or using their password, and make sure that their registered information shall not be used by the third party without their consent.   

2.    The Users shall be held liable for the management of all their personal information provided during the registration process. The Users shall also be held liable for any result arising from the negligent management or illegal use of their personal information.

3.    The Users shall be prohibited from engaging in actions intended to generate profit by using the Services provided by the Company without prior consent from the Company.

4.    The Users shall not copy, replicate, modify, translate, publish, broadcast or use in any other way, or transfer to the third party any information obtained through the Services provided by the Company without prior consent from the Company.

5.    The Users shall be prohibited from engaging in actions as follows in connection with the use of the Services provided by the Company:

1) providing false information in the application

2) illegally using other person’s registration information

3) intending to commit a crime or engaging in criminal acts

4) harming public morals or social order

5) defaming or insulting others

6) infringing on the rights of others including their intellectual properties

7) hacking computers or spreading computer viruses, or

8) any actions that prevent or may prevent the Company from operating the Services in a reliable manner

6.    The Users shall comply with the relevant laws, the provisions of these Terms of Use, user manuals or notices that the Company has publicized regarding the Services, and shall not engage in any actions that interfere with the Company’s business.

 

Article 10 Ownership of Rights

1.    All intellectual property rights and any other rights arising from the Services provided by the Company, postings, necessary software, images, logos, designs, the names of the Services, information and trademarks shall remain the exclusive property of the Company at all times.  

2.    The Users shall be prohibited from the modification, rental, sale, distribution, production, transfer, re-licensing, establishment of security rights, commercial use of the part or whole of each property specified in Paragraph 1 unless otherwise explicitly approved by the Company, and shall not allow the third party to do so.

 

Article 11 UDC Records

1.    The Company can record, document or publicize the UDC events by hiring a professional service provider (of photographs, videos, audios, streaming or other necessary services). These records and materials can be publicized or posted on the UDC website or social media sites, utilized in promotional activities to ensure the successful hosting of the UDC events, or covered by the media at the event venues. The duration of the use of such records shall not be limited.   

2.    The Participants acknowledge and consent to the fact that they may be photographed or video-recorded and their photographs or videos may be legally used in ordinary marketing or promotional activities to raise awareness of the UDC events.   

3.    By agreeing to participate as a Speaker at the UDC events, the Speaker gives the Company permission to use any information provided by themselves (speaker information, presentation materials, etc.) and their photographs or video footage when recording, publicizing or promoting the UDC events via the UDC website, social networking sites or online/offline media outlets.

 

Chapter 4 Other Terms and Conditions

Article 12 Limitation of Liability

1.    In no event shall the Company be liable for any acts of God or equivalent force majeure events which prohibit it from providing the Services.  

2.    In no event shall the Company be liable for any interruptions in use incurred by the User due to the reasons attributable to the User.

3.    In no event shall the Company be liable for the services provided free of charge by the Company unless otherwise specified in relevant laws pertaining to the use of the Services

4.    In no event shall the Company be liable to intervene for any dispute arising between the Users or between the User and the third party regarding the Services, nor shall it be liable for any loss or damages resulting from such dispute. 

5.    The User shall be held liable for any loss or damages incurred by the Company resulting from the violation of these Terms of Use by the User.

6.    The opinions expressed in the UDC events are those of the participants, speakers, exhibitors, participating firms or agencies, and do not necessarily reflect the views or positions of the Company. In no event shall the Company be liable for presentations, marketing materials or advertisements that have not been officially approved by the Company. 

 

Article 13 Governing Law and Jurisdiction

1.    Any dispute arising from these Terms of Use between the Company and the User shall be governed by the applicable laws of the Republic of Korea. 

2.    In the event that the dispute needs to be settled by the court, the court of competent jurisdiction shall be decided by mutual agreement between the Company and the User unless they fail to reach an agreement, in which case the court shall be determined in accordance with the Civil Procedure Act of the Republic of Korea.   

 

Appendix

These Terms of Use shall take effect from May 18, 2022.

If you do not indicate a refusal, you will be considered to have agreed to the terms.
